Welcome to Tech360. These Terms and Conditions ("Terms") govern your use of our website and services. By accessing or using our website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.
1. Definitions
"Company," "We," "Us," "Our" refers to Tech360, a registered business operating in Zimbabwe.
"Customer," "You," "Your" refers to any individual or entity accessing our services.
"Products" refers to all mobile devices, electronics, and related accessories offered through our platform.
"Services" refers to all e-commerce services, product sales, and customer support provided by Tech360.
2. Business Information
Tech360 operates as a technology products retailer in Zimbabwe, specializing in mobile devices, electronics, and accessories. All transactions and communications are subject to Zimbabwean law.
3. Product Information and Pricing
3.1 Product Descriptions: We strive to provide accurate product descriptions, specifications, and images. However, we do not warrant that product descriptions, images, or other content are accurate, complete, or error-free.
3.2 Pricing: All prices are displayed in US Dollars (USD) unless otherwise stated. Prices are subject to change without notice. We reserve the right to modify prices at any time.
3.3 Availability: Product availability is subject to change. We cannot guarantee that all listed products are in stock. In the event a product is unavailable after purchase, we will notify you promptly.
3.4 Errors: If a product is listed at an incorrect price or with incorrect information due to an error, we reserve the right to refuse or cancel any orders placed for that product.
4. Orders and Payment
4.1 Order Process: All enquiries and orders are processed through WhatsApp communication. No online payment system is currently active on our website.
4.2 Order Confirmation: We will confirm your order details via WhatsApp before proceeding. An order is only confirmed once we have verified availability and pricing with you.
4.3 Payment Methods: Accepted payment methods will be communicated during the order confirmation process and may include bank transfer, mobile money, cash on delivery, or other methods as agreed.
4.4 Payment Terms: Full or partial payment may be required before delivery, depending on the arrangement agreed upon.
4.5 Order Cancellation: We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.
5. Delivery and Shipping
5.1 Delivery Area: We primarily serve customers in Zimbabwe. Delivery areas and methods will be confirmed during order processing.
5.2 Delivery Timeframes: Estimated delivery times will be communicated during order confirmation. These are estimates only and may vary due to circumstances beyond our control.
5.3 Delivery Costs: Shipping and delivery charges, if applicable, will be communicated before order confirmation.
5.4 Risk of Loss: Risk of loss and title for products pass to you upon delivery to the carrier or upon pickup.
6. Product Warranties
6.1 Manufacturer Warranties: Products are covered by manufacturer warranties where applicable. Warranty terms vary by product and manufacturer.
6.2 Warranty Claims: All warranty claims must be made in accordance with the manufacturer's warranty policy. We will assist in facilitating warranty claims where possible.
6.3 No Additional Warranties: Except as expressly stated, we make no warranties, express or implied, regarding products, including warranties of merchantability or fitness for a particular purpose.
7. Returns and Refunds
Returns and refunds are subject to our Refund Policy. Please refer to our separate Refund Policy document for detailed information on eligibility, timeframes, and procedures.
8. Customer Obligations
8.1 Accurate Information: You agree to provide accurate, current, and complete information during all transactions and communications.
8.2 Lawful Use: You agree to use our services only for lawful purposes and in accordance with these Terms.
8.3 Product Inspection: You are responsible for inspecting products upon delivery and reporting any defects or damage within 48 hours.
8.4 Prohibited Activities: You may not use our services to engage in fraudulent activities, distribute malware, violate intellectual property rights, or engage in any illegal activities.
9. Intellectual Property
9.1 Ownership: All content on our website, including text, graphics, logos, images, and software, is the property of Tech360 or its licensors and is protected by copyright and trademark laws.
9.2 Limited License: You are granted a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes.
9.3 Restrictions: You may not reproduce, distribute, modify, or create derivative works from our content without express written permission.
10. Limitation of Liability
10.1 Disclaimer: To the maximum extent permitted by law, Tech360 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
10.2 Maximum Liability: Our total liability for any claim arising from or relating to these Terms or our services shall not exceed the amount paid by you for the specific product or service in question.
10.3 Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, civil unrest, government actions, natural disasters, or telecommunications failures.
11. Indemnification
You agree to indemnify, defend, and hold harmless Tech360, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services, violation of these Terms, or violation of any third-party rights.
12. Privacy and Data Protection
Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
13. Dispute Resolution
13.1 Informal Resolution: In the event of any dispute, we encourage you to contact us first to seek an informal resolution.
13.2 Mediation: If informal resolution is unsuccessful, disputes may be referred to mediation before pursuing formal legal action.
13.3 Governing Law: These Terms are governed by the laws of Zimbabwe. Any legal action must be brought in the courts of Zimbabwe.
13.4 Language: These Terms are written in English. In case of any translation, the English version shall prevail.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and Tech360 regarding the use of our services and supersede all prior agreements.
